The Federal Court of Justice has referred a fundamental question to the European Court of Justice: Are USM Haller shelving systems considered works of art or pure functional design? The answer will determine copyright protection periods and could affect the entire furniture industry. To date, copyright law distinguishes between applied art with a lower protection threshold and fine art – a boundary that is increasingly blurring with iconic design objects. The ECJ ruling will clarify which criteria will apply to future classifications.
